PROTECTION OF WOMEN AGAINST DOMESTIC VIOLENCE ACT 2005

Protection of Women against Domestic Violence Act 2005 .
Let’s us know about Rights of Women and their Protection if in our country any women is suffering from domestic violence or any form of violence.
This is an Act of Parliament enacted to protect from domestic violence. It was enforced by Indian government and Ministry of Women and Child Development on 26 October 2006.
This Act provides for the first time in Indian law definition of ” Domestic violence “.
Pursuant to the Act, the aggrieved person is defined as, any women who is, or has been in a domestic relationship with the respondent and who alleges to have been subjected to domestic violence by the respondent. This law not only protects the women from domestic within their husband – wife relationship, but women living in the same home with people with whom they are in the domestic relationship. This law protects women from within their relationship by marriage , relationship by blood, relationship by adoption and also relationship by nature of marriage.
Domestic violence is defined by Section 3 of the Act. “Any act omission or commission or conduct of the respondent shall Constitute domestic violence in case it :
● Harms or injuries or endangers the health, safety, life , limb or well being, whether mental or physical ,of the aggrieved person or tends to do so or includes causing physical abuse, sexual abuse, verbal or emotional abuse and economic abuse ; or
●harasses, harms , injuries or endangers the aggrieved person to coerce her or any other person related to her to meet any unlawful demand for dowry or other property or valuable security ; or
●has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned I clause (a) or clause (b); or
●otherwise injuries or causes harm , whether physical or mental, to the aggrieved person”.
The Act includes or defines not only physical violence but also all forms of violence such as emotional/verbal, sexual, economic abuse through the section chapter 1- preliminary.
Women’s safe and secured , there’s surely Development and progress in country as, it is known that one Women is Educated, Whole family Educated , if Women is respected , safe then Country becomes progresses on speediest level.
