POSITIVE SIDE OF ADVOCATES PROTECTION BILL,2021

The Bar Council of India on 2nd July, 2021 issued a draft of The Advocates Protection Bill 2021, considering the challenges and complications faced by the advocates and their families. The main objectives of this bill were to provide protection and relief to the advocates who face various hindrances during the performance of their duties. A team of seven members was constructed to draft this bill. The bill also mentions the reasons behind all the obstructions which hinder the execution of their responsibilities. The advocates’ fraternity is one of the essential wings of the justice delivery system, akin to the police and the judiciary. But while the police and the judiciary have access to protection, social security and other privileges, advocates are not given proper protection from anti-social elements.  The sudden need of the law was felt after a recent brutal incident of G Vaman Rao and his wife G Nagamani, who practised at the Telangana High Court, were waylaid by unidentified assailants while they were coming to Hyderabad, pulled out of their vehicle and hacked to death. Passersby shot videos of Vaman Rao lying on the road but did not offer help. A week back, Vaman Rao had taken a minor to the State Human Rights Commission after she was allegedly raped by her uncle and the police were accused of dragging their feet on her complaint. After such a heart wrenching incident , not only were advocates from the nation frightened but also feared from performing their professional duties .  The committee mainly focused on social security apart from physical protection and security . Cases of kidnappings, assault , criminal force , intimidation and disastrous threats to advocates while they perform their professional duties reached great heights. Such cases not only highlighted the deficiency of proper laws in order to provide proper protection to advocates but also instilled fear among them . To safeguard an advocate, such an act is necessary. The Bill states that no suit can be instituted against a lawyer who has been working in good faith. The communications between the advocates and the clients must be respectable. It has been come to notice that advocates face humiliation and malicious threats not only from their own clients but also from the rival parties . This Bill also gives the authority to the court to compensate advocates for any wrong committed to them . The term “Advocate” shall have the same meaning as provided under Sec. 2(1)(a) of the Advocates Act, 1961. The term “acts of violence” is defined in the same section. These ‘acts’ might include threats, harassment, coercion, assault, malicious prosecution, criminal force, harm, hurt, injury, and so on, all of which could have an impact on advocates’ living and working conditions. This also involves property loss or damage. Sections 3 and 4 of the Act mention about punishment and restitution. Punishments can range from six months to five years, with a maximum of ten years for repeat offenses. Penalties range from Rs.50,000 to Rs.1 lakh for the first offense, while fines for consecutive offenses can reach Rs.10 lakhs. “No Police Officer shall arrest an Advocate or investigate a case against an Advocate without the explicit direction of the Chief Judicial Magistrate,” according to Section 11.Another important provision which this bill talks about is social security. The act proposes  that the State and Central government have to make provisions to provide financial assistance to all needy Advocates of the country in unforeseen situations such as natural disasters or epidemics. A minimum of Rs.15,000 every month shall be provided. The advocates around the country are finally happy after the introduction of this draft. The final draft Bill shall be sent to the Honourable Minister for Law and Justice to table the same before the Parliament. This bill if becomes a law will not only open the gates of freedom for current advocates but will also raise the  morale of  the upcoming advocates . They will no longer have to fear for their families’ as well as their lives . This step taken by the committee is truly commendable as it will ensure adequate protection to members of the legal fraternity, so that they can carry on their duties as officers of the court, fearlessly without having to worry about their social and physical safety.
