Offences and types of offences:

let us study into simple terms.
The main object of law and order is to protect the society by penalising whose who breach the law which should be done with due regards to equity , justice and fair play. Therefore the trial proceedings is established to determined the guilt of the alleged accused in a fair and reasonable manner.


What is an offences?
The offense is derived from Latin word “offendere” which means to strive again and is considered as an evil act . In terms of act it is an Act which Is punishable by law.
The types of offences are :
The criminal procedure code determines two types of offences cognizable and non-cognizable offense. Further by the code it has been classified by Indian Penal code as bailable and non bailable offense.
Cognizable offence : As per the Cr.P.C section 2 clause (c) defines cognizable offence as those offences for which, and ‘cognizable case’ means a case in which the police officer may in accordance with the first schedule or under any other law for the time being in force arrest without a warrant. A police officer can arrest without a warrant and may investigate the case of such a nature without a orders or direction of the magistrates.
Non cognizable offence :
Non-cognizable offence means in which police authority has no authority to arrest without warrant. In such case police can arrest only with a warrant neither a police has authority to investigate the case without order given by the judicial magistrate.
Bailable offence:
According to section 2 (a) bailable offence means all offences which are shown as bailable in first schedule or any other law at the time in force , it is that offence which are not serious in nature. The person who is arrested can be apply for bail as a right and can be released accordingly after the bail is granted by the magistrate.
Non bailable offence:
In contrast to bailable offence, non bailable offences are serious in nature and right to bail becomes absent and therefore it is considered as a privilege which is given only at the discretion of the court. For Example murder, rape, kidnapping are non bailable offence.
