Miscarriage of Fast Track Justice in India
By: Aman Singh
“Justice delayed is justice denied”, you all hear this sentence in your life and it is rightly the present scenario of India. Justice though is difficult to define, but can be said that it varies according to situation and person. Since, now we live in democratic country like India were people are governed by the laws of the country, it is very important to deliver justice on time to the victims to prevent the miscarriage of justice. A very recent survey in India shows that there are approximately 3.2 crore cases spending in high and lower courts which means there is no meaning for justice and if it is there, it is in a very wrong time manner. But it doesn’t mean that justice should be hurried and consequently buried but justice should be melt in order to separate on a proper time basis and justice must be obviously done. But the present day of society is a victim feels very slow down of the process of justice. People unfortunately fall victim to injustice. Majority of the Indians are poor and illiterate but still they manage to go to courts to get justice by paying their hard-earned money to advocates, Law clerks and fail to get justice. This has been a curse and a major drawback of our Indian judicial justice.
And, when we talk about the case where we easily see how our Indian system fails to give punishment to the criminal, “Nirbhaya case can be the best example where the incident took place on 16th December 2012 which shook the whole country but thought the justice was delivered it was delivered on 10th September 2013 which was a delayed one. I a country like India where women are respected and treated like god, rap cases are on a very high zone and the ratio has been increasing day by day and eventually the justice delivered in such cases is also very time consuming where most of the rape victims would have already been on their dead bed. There should be same standerdisation on such rap cases where justice should be delivered as quickly as possible keeping in factor how cruel, brutal and ghastly the crime is. Several steps should be taken to reframe the judicial system by increasing the no of fast track courts and computerization of the whole countries judicial system by increasing the no of fast track courts and computerization of the whole countries judicial system is the need of the hour. The judges must set examples to themselves as well as others by being more punctual and dutiful. Honorable supreme court has already taken some steps like introducing E-filing where an advocate or a petioner can file his case online from anywhere in the world. Justice delayed and justice denied means that if justice is not carried out right away timely, then even if it is carried out later it is not really justice because there was a period of time when there was a lack of justice.
In short terms it means that if the justice is delayed by any cause it is very harmful to the people of any society.
