Gender Discrimination

In india, it is evident that sexism is an important concern from past many decades. People face discrimination based on their gender. Mostly we witness gender differences and inequality issues with trans and women of the country. Stereotypes and gender strength roles make the whole situation even worse. Gender inequality is faced everywhere right from work places to families we live in.

As per the traditional scenario, a specific gender get’s a superiority check over other genders and they rule everything under their dominance. It refers to any situation where a person is denied an opportunity or misjudged solely on the basis of their sex. It is illegal to privilege one gender with everything and let other genders suffer, fight for their rights, put extra efforts to grab opportunities which they might not get anyway and what not ?. We as humans deserve equality as our basic right and infringement of this right is indeed a violation of law and order.

Sexual discrimination is a major concern to combat. Letting a person’s gender decide their position and power or providing them with everything as a priority like job promotions, benefits ( privileges ), opportunities, etc. Is indeed a clear cut discrimination among genders. Hiring a person with superior gender status than a person with capabilities is unlawful and biased in the eyes of law. Well not only on work places but also this is an issue with societal norms as well.

Society discriminates among different genders too. We all must have heard these things while our families raised ourselves. Superiority and inferiority concepts. Barriers, decide strengths and judgmental opinions of society and so on. In india, judgmental, biased, unlawful norms of society often leads to criminal intentions and activities eventually such as promotion of selective sex terminations, gender based violences and offences, etc. Gender inequality in India refers to the health, education, economic and political inequalities between men and women. This also adversely affects sex ratio of the country.

Laws against gender discrimination

  • Article 14 of the Indian constitution
    > This article provides equality before the law and equal protection of the laws within the territory of India.
    It states –
    “The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.”
  • Article 15 of the Indian constitution
    > It says –
    “The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.”
    Article 15 secures the citizens from every sort of discrimination by the State, on the grounds of religion, race, caste, sex or place of birth or any of them.
  • Article 16 of the Indian constitution
    > It defines that there shall be equality of opportunity for all citizens in matters of employment under the State and no citizen shall, on grounds only of religion, race, caste, sex, descent, place of birth or any of them, be ineligible for any office under the State.
  • Article 39 (d) of the Indian constitution
    > This article provides thar there is equal pay for equal work for both men and women so their right should not be infringed at any point.
  • Article 42 of the Indian constitution
    > This article provides provision for The State shall make provision for securing justifiable and humane conditions of work and for maternity relief.
