That the marriage between the parties was solemnized on august 4 1978 as per hindu rites and ceremonies at delhi, an affidavit in support there of duly attested is filed here with

 

That the status and place of residence at the time of marriage and the time of filing petition as under:

That after marriage parties lived together as husband and wife with at house Badarpur, Delhi

That the reason for divorce is Joginder singh is Alcoholic Addicted, he is not giving the proper maintenance to his wife. The wife pushpa rani is also  Drug addicted and she is not in the possession to satisfy her husband that is why they are separating each other. They are living with each other from august 1978 to 1985.

The parties  has finally setup their mind to get the mutual consent divorce

that the parties of the settlement deed, can not file any suit, complaint for maintenance and for any claim for past/ present/future.

The mutual consent divorce is executed with: Mutual consent, not forcefully,sound mind, coercian, pressure under undue influence  or from third party. the vernacular language is used in this case law and both the parties are satisfied and every query in their knowledge.

PETITIONER NO 1 will file both the motion of divorce and PETITIONER NO 2  to file the PETITIONER NO 1 and expenses of filing of mutual consent divorce, PETITIONER NO 2  shall stand with PETITIONER NO 1

The wife will get back her ornaments also any kind of insurance and FD in future.

Both the parties will agree that no party will file any suit or petition in future , if any complaint is in process must be withdrawn U/S 12 of DV Act

That the cense of action for the present dispute arose on 14 august 1978 when both the parties got married in delhi it further arose in september 1985

That the hon’ble court has jurisdiction to adjudicate upon the present dispute as the marriage between the parties was performed at delhi and PETITIONER NO 1 is still residing in delhi  which is territorial jurisdiction off this hon’ble court.

The court fees 8000 is submitted in the court

PRAYER

Accordingly in the afore said fact and circumstances this hon’ble court may be pleased to dispose of the petition by passing an order in the above said terms of divorce by mutual consent arrived between the parties there by dissolving the marriage held on august 1978 as per hindu rites and ceremonies at delhi and by treating the afore said terms and condition as part of the decree on consent without cost for end of the justice.
