If you’re a working woman and you’re planning to have a baby or you’re pregnant, than you must go through the article to know about Maternity Benefits. Indian law makes it mandatory for most establishments to offer Maternity benefits to woman employees. Maternity Benefit in India is mainly governed by the Maternity Benefit Act, 1961.

Let us first quickly understand The Maternity Benefit Act:-

The Act regulates the employment of women in certain establishment for certain period before and after child-birth and to provide for maternity and certain other benefit. The  acts applies to mines, circus, factories, industry, plantation and shops and establishments employing ten or more persons, except employees covered under the Employees State Insurance Act, 1948. It can be extended to other establishment by the state government.

The main Objective of Maternity Benefit Act are as follows:-

  • To regulate the work of women in specific period prior and after delivery or labour.
  • To accommodate maternity benefits, including maternity leave, compensation, rewards, nursing breaks etc.
  • To secure respect towards Motherhood by accommodating the full and solid support for women and her child at this significant time when she isn’t working.

So no worry only relaxing during, before and after your pregnancy because Maternity Benefit Act is there for you.

Here are essentials to get Maternity Benefits:-

  • She must work not less than 80 days in the 12 months immediately preceding the date of her expected delivery.
  • 10 weeks before the date of her expected delivery, she may ask her employer to give her light work for a month. At that time, she should produce a certificate that she is pregnant.
  • She should give a written notice to the employer about seven weeks before the date of her delivery that she will be absent before and after her delivery.

So keep these points in your mind to receive Maternity Benefits.

Know about your Benefits as an Employee:-

  • You are entitled to take leave of 26 weeks (8 weeks before expected date of delivery and 18 weeks after expected date of delivery.
  • A medical bonus of Rs. 3500 (Minimum Amount)
  • In case of Miscarriage: Leave of 8 weeks, immediately after the date of miscarriage.
  • An additional leave to pay up to one month. (Proof of illness)
  • In case of Tubectomy Operation: Leave with wages for the period of 2 weeks.

Also know your Employer’s duty towards you:-

  • Every establishments having 50 or more employees shall have the facility of Creche`
  • Employer shall allow 4 visits a day to the creche to woman, which shall also include the interval for rest allowed to her.
  • Two nursing breaks until the child become 15 months old.
  • No deduction from the normal and usual daily wages of a woman who are entitled to Maternity Benefit.
  • No charge to be made on her in any of the conditions to her job while on maternity leave.
  • No discharge or dismissal when on maternity leave.
  • Light work for 10 weeks before delivery.
